Terms of Use

Article 1 — Purpose

Daytio is a SaaS online booking platform for self-employed professionals (hairdressing, barbering, beauty, nail care, wellness, tattooing, coaching…). It notably enables: publishing a booking page, managing a diary and availability, managing a client database, sending appointment notifications, and synchronising with external calendars.

Article 2 — Two categories of users

• Professionals: they create an account, publish their services and manage their appointments. The subscription to the service is governed by the Terms of Sale.
• End clients: they book an appointment with a professional, free of charge and without creating an account. Booking constitutes a commitment to attend the appointment or to notify the professional in case of inability to attend.

Article 3 — Daytio’s role

Daytio is a connection and management tool. The service contract (haircut, treatment, session…) is concluded directly between the client and the professional. Daytio is not a party to this contract: prices, quality, performance and cancellation of services are the professional’s responsibility. Payment for services is made directly to the professional.

Article 4 — Professional accounts

The professional guarantees the accuracy of the information provided (identity, trading name, services, prices, opening hours) and undertakes to keep it up to date. They are responsible for the confidentiality of their credentials; any action carried out from their account is deemed to have been performed by them. Access to the service is reserved for professionals acting in the course of their business.

Mandatory registration. Daytio is reserved for registered professionals holding a valid French business registration number (SIRET) (micro-entreprise, sole trader, company…). A professional without a SIRET number cannot be listed: Daytio connects registered service providers with their clientele, and is not intended to facilitate an undeclared business.

The professional undertakes to provide their SIRET number in their settings and to keep it accurate. Daytio reserves the right to suspend or close any account whose SIRET number is missing, incorrect, or corresponds to a deregistered business, after a request for correction has gone unanswered. Data from a suspended account is not deleted and remains recoverable by the professional.

No verification. Registration information is self-declared: Daytio carries out no verification with official registers and does not guarantee its accuracy, nor the regularity of the administrative, tax or social situation of listed professionals. These matters are the sole responsibility of the professional, who declares and guarantees that they carry out their business in accordance with applicable regulations.

Daytio cannot be held liable for an undeclared business carried out by a listed professional. Any such situation brought to its attention — by a client, a competent authority or any third party — will be reviewed and, where applicable, may lead to the suspension of the account concerned. Article 5 — Bookings and cancellations

• The slots displayed correspond to the professional’s actual availability at the time of consultation; a confirmed booking blocks the slot immediately.
• The client receives an email confirmation. In case of inability to attend, they contact the professional directly (contact details in the email).
• The professional may move or cancel an appointment; the client is then informed by email.
• For an appointment at the client’s home, the client guarantees the accuracy of the address provided and that it falls within the professional’s service area.

Article 6 — User obligations

Each user undertakes to use the service in accordance with the law and these Terms of Use. In particular, the following are prohibited: fictitious or abusive bookings, identity theft, publication of unlawful content (photos, descriptions), any attempt at unauthorised access to third-party data, and any disruption of the service. Daytio may suspend an account or block a use in case of a serious breach.

Article 7 — Content published by professionals

The professional guarantees that they hold the rights to the content they publish (photos, text, logo) and grants Daytio a non-exclusive licence to display this content solely for the purpose of providing the service (public page, directory). Content that is manifestly unlawful may be removed.

Article 8 — Personal data

The processing of data is described in the privacy policy. For their clients’ data, each professional acts as data controller and Daytio as processor, under the terms of the Data Processing Agreement (DPA). The professional undertakes to only collect via Daytio the data necessary to manage their appointments and to respect their clients’ rights (access, rectification, erasure).

Article 9 — Availability and liability

Daytio is provided “as is”, with a target of high availability but without a guarantee against interruption (maintenance, incident, force majeure). The publisher’s liability, whatever its cause, is limited to direct and foreseeable damages and, for professionals, to the amount of sums paid over the last twelve months of subscription. Daytio is not liable for the non-performance of booked services, which is the professional’s responsibility.

Article 10 — Intellectual property

The platform, its brand, interface and code remain the exclusive property of the publisher. No right other than the use of the service is granted.

Article 11 — Amendment of these Terms of Use

These Terms of Use may evolve. Professionals are informed of substantial changes by email at least 15 days before they take effect; continued use constitutes acceptance.

Article 12 — Governing law

These Terms of Use are governed by French law. Any dispute with a professional falls under the courts of the Quimper jurisdiction (the publisher’s registered office), subject to mandatory legal provisions; disputes with consumers fall under the protective rules of the French Consumer Code.
