These Terms of Sale govern the subscription to the Daytio service by professionals. Booking by end clients is free of charge and is not covered by these Terms of Sale (see the Terms of Use).

Article 1 — Scope

These Terms of Sale apply to any subscription to the Daytio service by a professional acting in the course of their business. Any subscription implies acceptance of these Terms of Sale and of the Terms of Use.

Article 2 — Description of the service

The subscription gives access to all of Daytio’s features: a public booking page with a permanent link and QR code, unlimited services, diary and availability management, a client database, email notifications, calendar synchronisation and a listing in the directory.

Article 3 — Free trial

Every sign-up opens a 30-day free trial, with no credit card and no commitment. At the end of the trial, access to the management space is suspended until a subscription is taken out; the professional’s data is retained in accordance with the privacy policy.

Article 4 — Price and payment

The subscription is offered at a price of 18 € per month (VAT not applicable, article 293 B of the French General Tax Code), with no fixed term. Payment is made by credit card, by monthly direct debit in advance, through a secure payment provider; online invoicing is being rolled out and, in the meantime, its arrangements are communicated by email. Prices may be revised; any increase is notified at least 30 days in advance and gives rise to a right of termination.

Article 5 — Term and termination

The subscription is monthly, automatically renewed, and may be cancelled at any time from the management space or by email to daytio.contact@gmail.com. Termination takes effect at the end of the current monthly period, with no pro-rata refund of the period already begun.

Article 6 — Right of withdrawal

As the service is intended for professionals for the needs of their business, the right of withdrawal under the French Consumer Code does not, in principle, apply. The 30-day free trial in any event allows the service to be evaluated at no cost. However, if the professional employs fewer than six staff and subscribes for a purpose outside the scope of their main activity (art. L221-3 of the French Consumer Code), they benefit from a 14-day right of withdrawal from the date of subscription, exercisable by email to daytio.contact@gmail.com.

Article 7 — Invoicing

An invoice is issued for each subscription period, sent by email to the account’s address and available in the management space.

Article 8 — Data portability

Upon termination, the professional may request an export of their client database and appointment history in a structured, commonly used format, for 30 days after closure.

Article 9 — Liability

The publisher’s liability is limited under the conditions set out in article 9 of the Terms of Use.

Article 10 — Governing law

French law. Failing an amicable resolution, the courts of the Quimper jurisdiction have exclusive competence, subject to mandatory applicable legal provisions.
